These Terms of Use (“these terms”) set out the rules for using our website www.kingsunlifeinsurance.com (“our site”).

By accessing and browsing any part of our site, it shall be deemed that you have read, understood, agreed and accepted to be bound by these terms. King Sun Life Insurance Limited (formerly known as Morgan Fuel Go Insurance Limited) (Co. Re. LL18181, License No. IS2024224) is a company incorporated in Malaysia, regulated by the Labuan Financial Services Authority and licensed under the Labuan Financial Services and Securities Act 2010 with its registered office at Level 1, Lot 7, Block F, Saguking Commercial Building, Jalan Patau-Patau, 87000 Labuan F.T., Malaysia (“King Sun”, “we”, “our”, “us”).  

King Sun and its related companies as defined in Section 4 of the Labuan Companies Act 1990 and jointly controlled entities are hereinafter collectively referred to as the “King Sun Group of Companies”.

The websites of other companies within the King Sun Group of Companies may contain terms and conditions which are different from these terms. When browsing the websites of other companies in the King Sun Group of Companies, please read and understand the terms and conditions of each website you visit and please bear in mind that these terms do not apply to those websites.

2. HOW WE MAY USE YOUR PERSONAL DATA 

Our privacy notice, available at www.kingsunlifeinsurance.com, (“Privacy Notice”) applies to you in addition to these terms. The Privacy Notice sets out the terms on which we process any personal data we collect from you, or that you provide to us. Please read our Privacy Notice carefully before proceeding. By using our site, you unconditionally agree to be bound by the terms of our Privacy Notice and consent to personal data processing and you confirm that all data provided by you is true and accurate. We shall not be held liable to you in any manner whatsoever in the event such data given to us is false.

3. AMENDMENTS

We reserve full rights to vary or amend these terms from time to time. For clarification purpose, such variations or amendments shall become effective on its effective date which we will update on our site and therefore you are encouraged to visit our site regularly for the latest terms. By continue accessing and browsing our site, you are deemed to have unconditionally accepted such variations or amendments and you shall be bound by the same.  

Additionally, we may update and change our site’s URL Link from time to time as we deem fit.

To the fullest extent permitted by applicable law, we (including directors, employees, representatives, agents and King Sun Group of Companies):

10. VIRUSES

We do not guarantee that our site will be secure or free from bugs, harmful content or viruses.

You shall remain fully responsible and accept full risks while browsing our site. Our site contains trademarks, including the King Sun name and logo. All trademarks on our site belong to King Sun and/or the relevant third-party proprietor. 13. GOVERNINGLAW

These terms shall be governed by the laws of Malaysia and shall be subject to the exclusive jurisdiction of the courts in Malaysia.

14. PROHIBITED USES

We only consent to the lawful use of our site. This means you cannot use our site:

· in any way that breaches any applicable local, national or international law or regulation.

· in any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.

· for the purpose of harming or attempting to harm minors in any way.

· to send, knowingly receive, upload, download, use or re-use any material contained herein without our consent.

· to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).

· to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

You also agree:

· not to reproduce, duplicate, copy or re-sell any part of our site in contravention of the provisions of our site, these terms and Privacy Notice; and

· not to access without authority, interfere with, damage or disrupt:

We may from time to time provide interactive services on our site, including, without limitation, live chat and bulletin boards.

Where we do provide any interactive service, we will provide clear information to you about the kind of service offered.

We do our best to assess any possible risks for users from third parties when they use any interactive service provided on our site. However, we are not under any obligation to oversee, monitor or moderate any interactive service we provide on our site.

Our interactive services cannot be guaranteed to be completely secure. We shall not responsible for any loss, damage or expense resulting from your use of, or inability to use, our interactive services including but not limited to service interruptions, delayed transmissions or incorrect data transmission.

16. INDEMNITY

You hereby irrevocably agree to indemnify and keep us fully indemnified against any action, loss, damage, costs or expense (including, but not limited to, reasonable administrative and legal costs) suffered or incurred by us arising from or directly or indirectly related to your use of our site or any breach or non-observance of these terms by you.

17. SUSPENSION AND TERMINATION

Where we detect a suspected breach of these terms as caused by you, we will determine in our absolute discretion whether it is in fact a breach. If we conclude that you have breached these terms, we have the right to take whatever remedial or protective action that we reasonably consider to be appropriate.

Failure to comply with these terms constitutes a material breach wherein such breach may result in us taking all or any of the following actions:

· immediate, temporary or permanent withdrawal of your right to access and use our site;

· immediate, temporary or permanent removal of any posting or material uploaded by you to our site;

· issue of a warning to you;

· initiate legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;

· further legal action against you; and/or

· disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

If we believe that we must do any of the above, we exclude liability for any of those actions taken in response to breaches of these terms or such other actions as we reasonably deem appropriate.

18. SEVERABILITY

Any term, condition, stipulation or provision contained herein which is illegal, void, prohibited or unenforceable shall be ineffective to the extent of such illegality, voidness, prohibition or unenforceability without invalidating the remaining provisions hereof, and any such illegality, voidness, prohibition or unenforceability shall not invalidate or render illegal, void, prohibited or unenforceable any other term, condition, stipulation or provision contained herein.

19. LANGUAGE

These terms are issued in English and Chinese. In the event of any inconsistencies or discrepancies between these versions, the English version of these terms shall prevail.
